At Premier Consult, medico-legal support to attorneys is one of our core offerings as a consultancy service provider and include Medical Negligence as well as Loss of Support Claims. As a part of our service, we develop extensive reports focussed on the integration of various expert reports and detailing any possible loss of earnings and career prospects in the support of our clients’ claim. Road Accident Fund (RAF) Claims
A Medico-Legal case is a legal case which requires medical expertise usually in the case of an injury or ailment.  Medico-Legal evaluations and reports are required when medical/psychological knowledge is sought to answer legal questions. At Premier Consult, only HPCSA registered Industrial Psychologists are assigned to conduct interviews with claimants and integrate reports. Our Industrial Psychologists establish and express an opinion by means of an integrated report to the instructing Attorneys (for presentation in court) on the following factors following an incident, injury at work or medical negligence:
  • Past and future loss of income and/or earning potential of injured individual
  • Future employability, increases and promotional opportunities
  • Limitations
  • Career prospects and plateau (pre-morbid vs post morbid)
Our analysis take into consideration the following:
  • Claimant’s socio-economic status
  • Family and educational background
  • Employment history
  • Obtained collateral information and reference to other expert opinions
  • Research of the conditions in the open labour market
Medical Negligence Claims

Medical negligence is defined as a negligent act or omission by a medical professional that results in personal injury to a patient and occurs when a medical professional's actions do not meet the accepted standards of practice. It's not only medical doctors who may be responsible for medical malpractice. Negligence by other medical professionals, such as nurses, dentists, osteopaths and those responsible for conditions in health care facilities like nursing homes, may also result in personal injury. Negligence may take the form of errors during the diagnosis, treatment or management of health conditions. It may also involve failure to obtain a patient's informed consent before undertaking a procedure or operation.

“Informed consent” exists only if a medical provider has thoroughly informed a patient about all the inherent risks, benefits and alternatives involved in any surgical or medical procedure or treatment, and that the patient has duly given written consent to proceed with the treatment.

Personal Injury Claims

When you have suffered a personal injury that was not your fault, you may be eligible for monetary compensation to cover the costs of the damages incurred. These costs are usually related to medical treatment or financial losses as a result of injury. Loss of Support Claims

If a close member of your family has been killed in a motor vehicle accident that was someone else's fault and the family member who died supported you financially, you can lodge a loss of support claim with the Road Accident Fund (RAF). As well as compensating those injured in accidents on South African roads, the RAF compensates the families of victims in the case of the death of a breadwinner. You can also claim compensation for funeral costs.
